17. Professional Collaboration and Consultation
17.1 To support a student’s learning, development and educational needs, Transcend Learning may, where appropriate and with the consent of the student’s parent or guardian, communicate and collaborate with third parties involved in supporting the student. These parties may include, but are not limited to, classroom teachers, schools, learning support staff, psychologists, occupational therapists, speech pathologists, paediatric or medical professionals, allied-health professionals, NDIS providers and other educational or support professionals nominated by the parent or guardian.
17.2 Transcend Learning will obtain appropriate parent or guardian consent before requesting, obtaining or disclosing personal, sensitive or health information for purposes of professional collaboration, except where collection, use or disclosure is otherwise permitted or required by law. Consent may specify the professional or organisation with whom Transcend Learning is authorised to communicate, the purpose of the collaboration and, where appropriate, the type of information that may be exchanged. A parent or guardian may withdraw or vary their consent by providing written notice to Transcend Learning. Withdrawal of consent will apply to future sharing of information and will not affect information lawfully collected, used or disclosed before consent was withdrawn.
17.3 Subject to the consent provided, information exchanged may include information reasonably necessary to support the student’s learning and educational needs, including learning process, assessment results, observations, and learning behaviours, areas of strengths or difficulty, learning goals, strategies and interventions used, relevant school information, reports and recommendations provided by other professionals. Transcend Learning will seek to limit the information collected, used or disclosed to information reasonably necessary and relevant to the purpose of the collaboration.
17.4 Personal, sensitive and health information received or created through professional collaboration will be treated as confidential and handled in accordance with applicable privacy and health-records legislation and Transcend Learning’s Privacy Policy. Transcend Learning will take reasonable steps to protect such information from misuse, interference, loss and unauthorised access, modification or disclosure. Information may be stored within Transcend Learning’s approved business systems, student records and other secure storage systems. It will only be accessible to persons who reasonably require access for the provision, administration or management of the student’s services, or as otherwise permitted or required by law.
17.5 Where Transcend Learning receives reports, assessments, recommendations, correspondence, or other information from a school, allied health professional or other third party, that information will be handled in accordance with the consent under which it was provided and applicable privacy requirements. Transcend Learning will not disclose that information to another third party unless authorised by the parent or guardian, reasonably necessary and permitted by law, or otherwise required or authorised by law.
17.6 Transcend Learning may maintain reasonable records of professional collaboration, including correspondence, consultation notes, reports, recommendations and agreed strategies, as part of the student’s records. Where a consultation is recorded by audio, video, or another recording method, specific consent will be obtained before recording, and the parties will be informed of the purpose of the recording and how it will be handled.
17.7 Professional collaboration, consultation, preparation, correspondence, report review and related administration may constitute an additional Service and be charged at the applicable rate set out in Transcend Learning’s Service & Fees schedule. Where applicable, Transcend Learning will obtain the required agreement before providing a chargeable Professional Collaboration Service.
18. Medical Conditions and Allergen Environment Disclaimer
18.1 Transcend Learning operates in a shared environment and cannot guarantee an allergen-free space. You acknowledge and agree that our premises are not nut-free or egg-free.
18.2 Please be advised that nuts (including peanuts and tree nuts, such as cashews), eggs, and their respective derivatives are regularly consumed on the property by other children participating in activities. Traces of nuts and egg are definitively present on the premises.
18.3 It is the responsibility of the parent or guardian to disclose any severe allergies or dietary restrictions prior to enrolment, provide an up-to-date Anaphylaxis or Allergy Action Plan, and ensure the student is equipped with necessary emergency medication (such as an EpiPen) during their Session.
18.4 By enrolling the student and utilising our Services, You acknowledge this environmental risk and agree that Transcend Learning is not liable for any allergic reactions that may occur on the premises, except to the extent caused by Our wilful conduct or gross negligence.
19. Student Drop-Off, Collection, Early Arrivals, Late Collections, Supervision and Unattended Waiting
19.1 Safe Drop-Off: Parents or carers must physically ensure the student has safely entered the premises and been received by a tutor before departing the property.
19.2 Transcend Learning accepts zero liability for any student left unattended outside the premises due to a parent or carer departing before confirming entry. This includes instances where a student is dropped off on the wrong day, at the incorrect time, or when the premises are closed and the student is left without a means of communication.
19.3 Due to the back-to-back nature of scheduled tutoring Sessions, tutors remain inside the premises to immediately commence instruction with the next scheduled student.
19.4 At the conclusion of their Session, students are instructed to exit the front or side of the Site to be collected by their parent, authorised carer, or designated emergency contact.
19.5 Transcend Learning explicitly instructs all students that if their parent or designated collector is not visibly waiting for them outside, they must immediately return inside the premises and notify a tutor.
19.6 You acknowledge and agree that Transcend Learning does not facilitate a physical, outdoor handover of the student to the parent or carer. Transcend Learning assumes no liability for the student once they exit the building at the conclusion of their scheduled Session, provided the student has been instructed in accordance with clause 19.5.
19.7 Unattended Waiting, Early Arrivals, Late Collections & Use of Amenities: Transcend Learning is solely responsible for the student during their strictly scheduled Session time. We do not provide pre-session or post-session supervision.
19.8 If a student arrives early or is collected late, and staff permit or direct them to wait on the property and use outdoor play equipment (such as trampolines or monkey bars) while waiting for their session to commence or for their parent/carer to arrive, they do so entirely at their own risk.
19.9 In the event a student arrives early, is dropped off incorrectly, is collected late, or is instructed by their parent/carer to wait outside the premises (such as on the deck)—including instances where Transcend Learning staff may be temporarily off-site or inside teaching another student—the parent/carer assumes full, absolute responsibility for the student’s safety and wellbeing. Transcend Learning accepts zero liability for any injury, loss, or incident that occurs while a student is waiting unattended or playing on the property outside their scheduled Session time.
20. Public Holidays, Regional Events and Operating Hours
20.1 Transcend Learning’s operating schedule on public holidays, gazetted regional event days (including the Geelong Cup and Melbourne Cup), and school holiday periods is determined solely at the discretion of Management.
20.2 Unless Transcend Learning provides explicit written notice of closure, scheduled tutoring Sessions remain active, required, and payable on public holidays and local event days.
20.3 Transcend Learning reserves the right to operate Sessions on public holidays, during regional events, or during periods of owner absence by utilising suitably qualified substitute tutors or staff. The absence of the business owner does not constitute a cancellation of services.
20.4 Where Transcend Learning elects to close for specific regional holidays (such as Melbourne Cup weekend) or planned leave, families will be given advance notice, and affected Sessions will be managed in accordance with Our standard makeup and rescheduling policies.
